Introduction

Welcome to Recipe.Site. These Terms of Service (“Terms”) govern your access to and use of our website, services, and applications (collectively, the “Services”). Recipe.Site (“we,” “us,” or “our”) provides a modern publishing platform for chefs and recipe creators to publish and monetize their recipes and other content.

By accessing or using any part of the Services, you agree to be bound by these Terms, our Privacy Policy, and any other policies referenced herein. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any Services.

1. Definitions

  • “Creator” refers to a user who creates an account on Recipe.Site, has access to the Creator Dashboard, and publishes content on a website hosted by Recipe.Site (e.g., username.recipe.site).

  • “User” refers to any individual who visits a website hosted by Recipe.Site, whether or not they have a Recipe.Site account.

  • “Your Content” refers to any recipes, blog posts, images, videos, or other materials that you, as a Creator, upload, publish, or transmit through the Services.

  • “Embed Services” refers to Recipe.Site APIs, JavaScript libraries, and related backend functionality (including comments, ratings, end-user accounts, and newsletter delivery) made available for integration on websites or platforms that are not hosted by Recipe.Site (e.g., a customer's Webflow, WordPress, or custom site).

  • “Embed Customer” refers to a customer of Recipe.Site who uses the Embed Services on a website or platform they operate outside of Recipe.Site-hosted domains. Use of the Embed Services is governed by these Terms together with a separate written Service Agreement that supplements and, where applicable, supersedes these Terms.

  • “End User” refers to any individual whose personal information is collected, stored, or processed through your use of the Services — including visitors to a Recipe.Site-hosted website, commenters, raters, newsletter subscribers, and account holders interacting with an Embed Customer's site. As between you and Recipe.Site, you are the data controller for End User data and Recipe.Site is the data processor.

2. Account Terms

  • Account Creation: To become a Creator, you must register for an account. By registering, you agree to provide accurate, current, and complete information as prompted by the registration form.

  • Age Restriction: You must be at least 16 years of age or the age of majority in your jurisdiction, whichever is higher, to create an account and use the Services.

  • Account Responsibility: You are responsible for maintaining the security of your account and password. Recipe.Site cannot and will not be liable for any loss or damage from your failure to maintain the security of your account and password. You are responsible for all activity that occurs under your account.

  • Free Trial: All new Creator accounts begin on an “Free Trial,” limited to publishing a maximum of 3 recipes.

  • Pricing Changes: For paid plans, Recipe.Site will provide at least thirty (30) days' written notice (by email or in-product notice) of any change to recurring fees. If you do not agree to a price change, you may terminate your paid plan within fourteen (14) days of the notice without further obligation; otherwise, continued use after the effective date constitutes acceptance of the new pricing.

  • Embed Customer Obligations: If you are an Embed Customer, the following additional terms apply:

    • Use of the Embed Services is limited to the domains expressly authorized in your Service Agreement. Use on any other domain, white-labeling for third parties, or resale of the Embed Services is prohibited without Recipe.Site's prior written consent.

    • As between you and Recipe.Site, you are the data controller for all End User data collected through the Embed Services on your authorized domains, and Recipe.Site is the data processor.

    • You are solely responsible for publishing and maintaining your own terms of service, privacy policy, and (where applicable) cookie or consent notices on your authorized domains, covering the collection, processing, and use of End User data in compliance with all applicable laws, including but not limited to CAN-SPAM, GDPR, UK GDPR, and CCPA.

    • If your End User base includes individuals located in the EU, UK, or other jurisdictions requiring a written data-processing agreement, the parties will execute a Data Processing Addendum consistent with GDPR Article 28 (or equivalent) prior to the relevant processing activity, upon written request from either party.

3. Your Content and Publishing

  • Content Types: As a Creator, you can publish recipes and blog posts on your Recipe.Site-hosted website.

  • Digital Cookbooks: As a Creator, you may create and sell digital cookbooks through the Services. Digital cookbooks are interactive, web-based versions of cookbook content with enhanced functionality provided by Recipe.Site. The specific features available for digital cookbooks may change over time as the platform evolves.

  • Content Restrictions: You agree not to upload, publish, or transmit any of Your Content that:

    • Infringes or violates the intellectual property rights or other rights of any third party (including copyright, trademark, privacy, or publicity rights).

    • Is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another’s privacy, hateful, or racially, ethnically, or otherwise objectionable.

    • Contains viruses, Trojan horses, worms, time bombs, or any other harmful or deleterious programs.

    • Constitutes spam or unauthorized advertising.

  • No Content Moderation: Recipe.Site does not actively moderate Your Content. Each Creator’s site is independent. We reserve the right, but have no obligation, to remove or refuse to distribute any of Your Content on the Services, and to terminate or suspend users.

  • Intellectual Property Rights (Your Content): You retain all ownership rights to Your Content that you upload, publish, or display on or through the Services. By uploading, publishing, or displaying Your Content, you grant Recipe.Site a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, modify (for formatting purposes, e.g., to fit layout), perform, display, distribute, and otherwise disclose to third parties Your Content solely for the purposes of operating, promoting, and improving the Services. This includes making Your Content available to users who visit your Recipe.Site-hosted website.

  • Accuracy of Content: You are solely responsible for the accuracy, completeness, and legality of Your Content, including any recipes, health advice, or outcomes derived from your recipes. Recipe.Site is not responsible for and does not endorse any content posted by its Creators.

4. Digital Cookbook Terms

  • Content Rights and Export: Creators retain all intellectual property rights to their digital cookbook content. Recipe.Site will provide a JSON export of content upon request or account closure.

  • Recipe Gifting: Purchasers of digital cookbooks may gift a limited number of individual recipes to others as determined by Recipe.Site. This gifting functionality is intended to promote sharing while respecting the Creator's commercial interests.

  • Removing Titles or Closing Digital Cookbook Shop: Creators may remove individual titles or close their digital cookbook shop at any time. Upon removal:

    • Recipe.Site will provide a JSON export of all content.

    • Customers who purchased removed titles will have 60 days to download a PDF version of their purchased content.

    • Creators may alternatively choose to migrate content to Recipe.Site's digital cookbook marketplace, where Recipe.Site will continue hosting and selling the content under revised revenue share terms specified at the time of migration.

  • Discontinuation of Digital Cookbook Service: In the event Recipe.Site discontinues the digital cookbook service:

    • Creators will receive 6 months advance notice.

    • All content will be exported and provided to Creators in JSON format.

    • Recipe.Site will provide reasonable assistance with migration to alternative platforms.

    • Customers will have 60 days to download PDF versions of purchased cookbooks.

5. Monetization and Payments

  • Monetization Options: As a Creator, you have the option to monetize Your Content through our Services, including user subscriptions, digital cookbook sales, ad sales, and the integration of third-party advertising services (e.g., Raptive, MediaVine, Google Ads) and affiliate links.

  • Revenue Share:

    • For recurring user subscriptions and ad sales processed via Recipe.Site: Recipe.Site retains a 6% platform fee.

    • For one-time recipe collection and digital cookbook sales: Revenue share terms are established in individual Creator agreements. Payment processing fees are deducted from Recipe.Site's share of revenue.

    • Creators set their own pricing for recipe collections and digital cookbook titles, subject to any pricing guidelines or restrictions specified in their Creator agreement.

    • The platform fee does not apply to revenue generated through third-party advertising services or direct affiliate link commissions.

  • Payment Processing: Recipe.Site uses Stripe Connect, a third-party payment processor, to facilitate all financial transactions related to user subscriptions, recipe collection sales, digital cookbook sales, and ad sales. By using the monetization features, you agree to be bound by the Stripe Connected Account Agreement (available at https://stripe.com/connect/legal), and you authorize Recipe.Site to collect and disburse funds on your behalf via Stripe. You agree that Recipe.Site is not liable for any issues arising from the processing of payments by Stripe.

  • Billing Cycles & Cancellations: Subscriptions for paid Creator accounts or for subscribing to a Creator’s site can be paid monthly or yearly. Payment is automatically charged at the beginning of each billing cycle. You may cancel your subscription at any time. Upon cancellation, your access to paid features or subscribed content will continue until the end of your current billing period. No refunds will be provided for any unused portion of a subscription period.

6. Data Handling and Privacy

  • Information We Collect: We collect personal information such as your email address for basic Creator accounts. For paid Creator plans (“Hobby”, “Creator”, and “Enterprise”) and for users subscribing to a Creator’s site or purchasing recipe collections or digital cookbooks, we collect payment information via Stripe. You may optionally provide your name and photo for your account. All Recipe.Site-hosted websites utilize Google Analytics, which collects website usage information.

  • Data Storage and Protection: All data is stored on our servers. We implement commercially reasonable security measures to protect your data; however, no method of transmission over the Internet or method of electronic storage is 100% secure.

  • Creator’s Responsibility for User Data: As a Creator, if you integrate third-party tools or services (e.g., ad networks) that collect data from your website visitors, you are responsible for ensuring your compliance with applicable data privacy laws, including potentially having your own privacy policy for your site.

7. Service Availability and Data Export

  • Service Availability: Recipe.Site uses commercially reasonable efforts to make the Services available 24 hours a day, 7 days a week. We do not warrant uninterrupted access. Planned maintenance windows will be communicated by email or in-product notice at least 48 hours in advance where practical. Unplanned downtime caused by force majeure events, third-party provider outages, denial-of-service attacks, or other circumstances outside our reasonable control is excluded.

  • Support: Email-based support is available to all paying customers at the email address listed in your account or Service Agreement. Response time targets, if any, are described in your plan documentation or in a separate Service Agreement. Recipe.Site does not provide telephone or guaranteed-response support unless expressly agreed in writing.

  • Data Export: You may request a full export of your account data — including recipes, blog posts, digital cookbook content, and End User records such as comments, ratings, and newsletter subscribers, where applicable — in a structured, machine-readable format (JSON or CSV) at any time, free of charge. We will deliver the export within thirty (30) days of a written request.

  • Account Closure and Data Deletion: Upon termination of your account by either party, Recipe.Site will retain your account data for thirty (30) days, during which you may request a final export. After this retention window, your data will be removed from production systems and from backups within sixty (60) days, except where longer retention is required by applicable law or to enforce these Terms.

8. Third-Party Integrations and Subprocessors

Recipe.Site uses the following third-party providers (each, a “Subprocessor”) to deliver the Services. Your use of the Services involves the processing of data by these providers, subject to their respective terms and privacy policies. We are not responsible for their independent practices.

  • Stripe — payment processing for subscriptions, recipe collections, and digital cookbook sales.

  • Amazon Web Services (AWS S3 and AWS SES) — file storage for media assets and transactional/marketing email delivery (including newsletters and one-time-password verification emails).

  • Neon — managed PostgreSQL database hosting.

  • Vercel — application hosting, edge delivery, and queue processing.

  • Google (Gemini API and Google Analytics) — AI-assisted recipe parsing and website usage analytics on Recipe.Site-hosted websites.

We may update the list of Subprocessors from time to time. Material changes will be communicated in accordance with the “Changes to Terms” section.

9. User Conduct and Enforcement

Prohibited Conduct: You agree not to:

  • Violate any applicable local, state, national, or international law or regulation.

  • Engage in any form of harassment, hate speech, or discrimination.

  • Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.

  • Attempt to gain unauthorized access to any portion of the Services or other systems or networks connected to the Services.

  • Interfere with or disrupt the integrity or performance of the Services or data contained therein.

  • Use the Services for any fraudulent or deceptive purposes.

Newsletter and Email Sending: If you use the Services to send newsletters, broadcast emails, or any other bulk or marketing email to a recipient list, you additionally agree to the following:

  • You will send only to recipients who have provided affirmative, opt-in consent to receive your communications. Purchased, rented, scraped, or otherwise non-consenting recipient lists are strictly prohibited.

  • Every email sent through the Services must comply with CAN-SPAM and any other applicable anti-spam laws, including a working unsubscribe mechanism and a valid physical mailing address.

  • You will configure SPF, DKIM, and DMARC records on your sending domain as instructed by Recipe.Site during onboarding.

  • If any send produces a hard-bounce rate greater than 5% or a complaint rate greater than 0.1%, Recipe.Site may require you to clean your recipient list before subsequent sends and may suspend further sending until cleanup is completed, in order to protect the deliverability reputation of shared sending infrastructure (including AWS SES).

  • Recipe.Site may, at its discretion and without prior notice, suspend or terminate your access to email sending features if your use materially threatens the deliverability, security, or reputation of shared sending infrastructure.

Consequences of Violations: If you violate these Terms, Recipe.Site reserves the right to take any action it deems appropriate, including but not limited to:

  • Removing Your Content.

  • Suspending or terminating your account.

  • Blocking your access to the Services.

  • Reporting your conduct to law enforcement authorities.

  • Forfeiting any earned revenue if the violation is related to fraudulent or prohibited monetization activities.

10. Disclaimer of Warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE. RECIPE.SITE DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICES OR THE SERVERS THAT MAKE THEM AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOU ACKNOWLEDGE THAT YOUR USE OF THE SERVICES IS AT YOUR SOLE RISK.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL RECIPE.SITE, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THE SERVICES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, RECIPE.SITE’S TOTAL CUMULATIVE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) ONE THOUSAND U.S. DOLLARS ($1,000.00) OR (B) THE AMOUNT YOU PAID RECIPE.SITE FOR THE SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

YOU EXPRESSLY AGREE THAT RECIPE.SITE IS NOT RESPONSIBLE FOR THE CONTENT PUBLISHED BY CREATORS ON THEIR RECIPE.SITE-HOSTED WEBSITES, INCLUDING BUT NOT LIMITED TO THE ACCURACY OF RECIPES, ANY HEALTH OR NUTRITIONAL ADVICE, OR THE OUTCOMES OF USING SUCH RECIPES. ANY RELIANCE ON SUCH CONTENT IS AT YOUR OWN RISK.

12. Indemnification

You agree to defend, indemnify, and hold harmless Recipe.Site, its affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney’s fees) arising from: (a) your use of and access to the Services; (b) your violation of any term of these Terms; (c) your violation of any third-party right, including without limitation any copyright, property, or privacy right; or (d) any claim that Your Content caused damage to a third party.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Vermont, United States, without regard to its conflict of law principles.

Any dispute arising out of or relating to these Terms or the Services shall be resolved exclusively through binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules, rather than in court. The arbitration shall take place in Vermont. The decision of the arbitrator shall be final and binding. You agree that you may bring claims against Recipe.Site only in your individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.

14. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Services after any revisions become effective, you agree to be bound by the revised terms.

15. Miscellaneous

  • Entire Agreement: These Terms, together with the Privacy Policy and any other legal notices published by Recipe.Site on the Services, constitute the entire agreement between you and Recipe.Site concerning the Services.

  • Severability: If any provision of these Terms is deemed invalid, void, or for any reason unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

  • No Waiver: No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and Recipe.Site’s failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

  • Assignment: You may not assign or transfer these Terms, by operation of law or otherwise, without Recipe.Site’s prior written consent. Any attempt by you to assign or transfer these Terms, without such consent, will be null and of no effect. Recipe.Site may freely assign or transfer these Terms without restriction.
